Philadelphia County's first known Pre-Birth Order ("PBO") for a child conceived in vitro by a surrogate for male same-sex partners was recently obtained by attorney Dorothy K. Phillips from the Court of Common Pleas of Philadelphia County, Pennsylvania.
The life-partners used a gestational carrier ("surrogate") to carry and bear their child in December 2009 in a Center City hospital. The PBO names the life partners as the legal parents of the child at the time of birth, eliminating the surrogate as mother. This avoids having the non-genetic partner terminate the parental right of the surrogate and then adopting the child.

Phillips is a member of the Bar of Pennsylvania and New Jersey. She works closely with Surrogacy Agencies concerning both heterosexual and gay couples seeking to have a child by in vitro fertilization with a surrogate carrying the fertilized embryo. read full story
