In his State of the Union address Wednesday night, President Obama spoke about his plans to repeal the law that denies gays the right to serve in the military. Perhaps this announcement will have a domino effect for gay rights on the state level. Philadelphia County's first known Pre-Birth Order ("PBO") for a child conceived in vitro by a surrogate for male same-sex partners was recently obtained by attorney Dorothy K. Phillips from the Court of Common Pleas of Philadelphia County, Pennsylvania. The life-partners used a gestational carrier ("surrogate") to carry and bear their child in December 2009 in a Center City hospital. The PBO names the life partners as the legal parents of the child at the time of birth, eliminating the surrogate as mother. This avoids having the non-genetic partner terminate the parental right of the surrogate and then adopting the child.
Phillips is a member of the Bar of Pennsylvania and New Jersey. She works closely with Surrogacy Agencies concerning both heterosexual and gay couples seeking to have a child by in vitro fertilization with a surrogate carrying the fertilized embryo. read full story
Recent News:
The Supreme Court of Pennsylvania voted unanimously for gay and lesbian employees of the Pennsylvania judiciary to receive the same medical benefits as heterosexual employees. This policy will take effect March 1 and includes medical coverage, dental, vision, and prescription plans.
Phillips quoted in Legal Intelligencer Article:
Dorothy K. Phillips was recently quoted in regard to the decision in the case M.A.T. v. G.S.T on January 21st, 2010. This case established equal rights for homosexual parents in regard to custody disputes. The Legal Intelligencer article appeared in the January 25, 2010 issue.

Dorothy Phillips' next article will be published in the Pennsylvania Law Weekly on February 15, 2010 and will focus on the case M.A.T. v. G.S.T., which was decided by the Superior Court on January 21, 2010. This case overruled a 1985 case, which had established an evidentiary presumption against a homosexual parent in a custody matter. Now, every parent, no matter what his/her sexual orientation is on equal footing in regards to custody. The article will also be availble on this site under Publications.
