DIVORCE
Divorce constitutes the legal termination of a marriage. No-fault divorce is prevalent in almost all states now where irreconcilable differences or incompatibility are the grounds for divorce. Divorce can only be granted by state courts, pursuant to the terms of the United States Constitution. See Community Property, Equitable Distribution and Same-Sex Unions.
DNA TESTING
DNA testing can establish to a great degree of certainty the paternity of a child. DNA also serves to give information to a court as to whether a parent is using drugs and/or alcohol.
DOUBLE - DIPPING
When a court applies the same funds for support purposes and for property purposes. An example of double-dipping is using severance pay for both support and equitable distribution purposes. It cannot be used for both.
